Terms of Use

HTV Image Database

  1. Consent
    By agreeing to the terms of use, a legally binding contract is concluded between you and the Harz Tourism Association (HTV) for the use of images from the online image database.
     
  2. Download
    After registration, the images can be downloaded free of charge from the image database at www.harzinfo.de.
     
  3. Rights of use
    Only a non-exclusive right of use is granted under the following conditions. Any opposing terms and conditions of the user are hereby rejected.
     
  4. Intended use
    The images are available free of charge for your editorial reporting about the Harz region within the scope of (tourism) marketing, e.g. in travel catalogues or newspaper articles. Use by picture and book publishers and any commercial use is excluded unless otherwise agreed by separate contract.
    Any type of usage where the image forms the basis for generating commercial economic profit (e.g. illustrated books, travel and hiking guides, postcards, calendars, posters, pictures for company & business equipment, etc.) is excluded from the free use of our images.
    Please note that if the stated information does not match the actual use of the photo, the granted permission to use it becomes invalid.
    The following use is permitted: print and online use with the exception of social media channels. 
    The images may be used both in print and online under the specified conditions. This means you may use the images for the following print or website applications: e.g. articles, travel catalogues, brochures, magazines, flyers, homepage. Always observe the specified source credit, which must be included in all cases. 
     
  5. Copyright
    The images are the property of the stated rights holder and are protected accordingly. The HTV and its licensors hold the necessary rights to the images. As part of the download, only those rights required to realise the approved usage purpose are transferred. HTV grants a simple, non-transferable right of use. Non-transferable means the images must be used either for your own purposes or for your direct employer, direct client, or direct customer who is the end user of the image. The images or rights may not be passed on to third parties. The images may not be sold, rented, lent, or otherwise transferred.
     

  6. Fee
    The image data is provided free of charge. Exceptions – see intended use.

    The images may not be used for the following purposes:
    - To defame, discriminate against, or disparage products, natural or legal persons
    - In connection with topics (including but not limited to) sex, contraception, abuse, violence, physical or mental disabilities, illnesses, cancer, AIDS, drug abuse, alcohol, cigarettes, etc.
    - For pornographic purposes
    - For extreme political parties
    - In connection with a negative portrayal of the Harz region.

  7. Indemnification from third-party claims
    The Harz Tourism Association must be indemnified against any third-party claims that arise from the use of an image not expressly permitted by this agreement.
     
  8. Liability
    The Harz Tourism Association assumes no liability whatsoever for the usability/marketability/fitness of the images for any particular purpose.
     
  9. Image modifications
    The downloaded images must not be altered in themselves and must be proportionally scaled.
     
  10. Violation
    In the event of a violation of these terms of use, the Harz Tourism Association may require the user to withdraw or correct, at their own expense, any products containing the press images, or to cease distribution entirely. Furthermore, in such cases, the HTV reserves the right to assert legal claims, including claims for damages.
